1. Agreement to Terms

By accessing or using HABANO at habano.app you agree to be bound by these Terms. If you do not agree do not use the App. These Terms apply to all users including guests, registered users, vendors, and businesses.

2. About HABANO

HABANO is a premium Havana cigar lifestyle discovery and concierge platform operated by Habano App LLC. HABANO is a discovery and concierge platform only. We do not sell tobacco or cigars, sell transportation services, operate transportation vehicles, employ drivers guides or vendors, process payments between users and businesses, or guarantee the availability quality or safety of any listed business vendor or service.

All transactions and arrangements made through WhatsApp or in person are between you and the third party directly. HABANO is not a party to those transactions.

3. OFAC and Sanctions Compliance

Habano App LLC is an independent company. We are not affiliated with, endorsed by, or a member of any US government agency or sanctions program including the Office of Foreign Assets Control (OFAC). We are not responsible for your compliance with OFAC regulations or any US sanctions related to Cuba.

Users are solely responsible for ensuring their own compliance with all applicable US laws and regulations including OFAC regulations regarding travel to Cuba and transactions with Cuban nationals or Cuban entities. Habano App LLC does not facilitate, process, or handle any financial transactions between US persons and Cuban nationals or Cuban entities. All service arrangements are made directly between users and independent third-party providers through WhatsApp. Habano App LLC is not a party to any such transaction.

US travelers are advised to verify their own eligibility to travel to Cuba under current OFAC general licenses before using this App. For current OFAC regulations visit: https://ofac.treasury.gov

4. Eligibility

You must be at least 17 years old to use the App. By using the App you represent that you are at least 17 years old, have the legal capacity to enter into these Terms, and will comply with all applicable laws including OFAC and US sanctions regulations.

5. Account Registration

You may browse the App as a customer without an account. To access full features including check-ins, journey tracking, and reviews you must create an account using Google Login or Apple Login. You are responsible for maintaining the security of your account and all activity that occurs under your account.

Account types: Traveler accounts for individual users and cigar enthusiasts. Vendor accounts requiring WhatsApp number, government ID upload, and selfie for verification. Business accounts requiring admin approval or in-person onboarding QR.

6. User Conduct

You agree not to use the App for any unlawful purpose including any purpose that violates OFAC regulations or US sanctions laws, post false misleading or fraudulent information, impersonate any person or entity, harass threaten or harm other users, submit fake reviews or manipulate ratings, attempt to circumvent security measures, or use the App in any way that disrupts or damages the platform.

7. Transportation Services

The App facilitates connections between users and independent transportation providers through WhatsApp. HABANO does not operate own or control any transportation vehicles, employ or supervise drivers, set transportation prices, guarantee transportation availability or safety, or process or handle any payment for transportation.

All transportation arrangements are made directly between you and the transportation provider. You use transportation services at your own risk. We recommend only using verified vendors listed in the App and confirming pricing before accepting a ride.

8. VIP and Concierge Services

The App facilitates connections to VIP lounges, tour guides, and concierge services through WhatsApp. HABANO does not guarantee VIP access or availability, employ tour guides or concierge staff, set prices for VIP or concierge services, or process or handle any payment for these services. All arrangements are made directly between you and the service provider.

9. Business and Vendor Listings

Businesses and vendors listed in the App are independent third parties. HABANO does not endorse or guarantee any listed business or vendor, verify the accuracy of all business information, guarantee business hours availability or quality, or take responsibility for any experience at a listed business.

10. Reviews and User Content

You retain ownership of content you submit. By submitting content you grant us a non-exclusive license to display it in the App.

Reviews must be based on genuine personal experience, honest and accurate, and free from hate speech harassment or offensive content. Reviews can only be submitted after a verified interaction — a QR scan or app-triggered WhatsApp communication.

11. Exchange Rate Information

Exchange rate data is sourced from elToque (eltoque.com), an independent Cuban economic research publication that monitors informal market rates. These rates are estimates and may vary from actual exchange rates available in Cuba. This information is provided for general guidance only. It is not guaranteed to be accurate or current, not financial or currency exchange advice, and subject to delays and technical limitations. Always verify exchange rates through official sources before making financial decisions.

12. Travel Information and Tips

The App provides travel tips, customs information, and travel guides for Cuba. This information is provided in good faith but laws and regulations can change without notice. This is not legal advice. Always verify customs and immigration requirements with official sources before traveling. Habano App LLC is not responsible for any loss, confiscation, or legal consequence resulting from reliance on travel information provided in the App.

13. Intellectual Property

All content in the App including design, logos, text, and code is owned by Habano App LLC or its licensors. You may not copy, reproduce, or distribute App content without permission, use our trademarks or branding without written consent, or reverse engineer or copy the App.

14. Privacy

Your use of the App is governed by our Privacy Policy available at habano.app/privacy. By using the App you agree to our Privacy Policy.

15. Disclaimers

THE APP IS PROVIDED AS IS WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING ACCURACY OR COMPLETENESS OF BUSINESS LISTINGS, AVAILABILITY OR RELIABILITY OF THE APP, SAFETY OR QUALITY OF ANY BUSINESS VENDOR OR SERVICE, ACCURACY OF EXCHANGE RATE OR TRAVEL INFORMATION, AND COMPLIANCE OF ANY USER'S ACTIVITIES WITH OFAC OR US SANCTIONS REGULATIONS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW HABANO APP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF DATA OR BUSINESS INTERRUPTION, ANY HARM RESULTING FROM USE OF TRANSPORTATION OR SERVICES ARRANGED THROUGH THE APP, ANY ACTIONS OR OMISSIONS OF LISTED BUSINESSES OR VENDORS, INACCURATE BUSINESS LISTINGS OR TRAVEL INFORMATION, OR ANY LEGAL CONSEQUENCES ARISING FROM A USER'S FAILURE TO COMPLY WITH OFAC OR US SANCTIONS REGULATIONS.

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

17. Indemnification

You agree to indemnify and hold harmless Habano App LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, your interaction with any business vendor or service through the App, or your failure to comply with OFAC regulations or any applicable US sanctions laws.

18. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida, United States.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the App and updating the effective date. Continued use after changes constitutes acceptance.

20. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from Settings in the App.
